What changes

  • BeforeThe board could not renew a pharmacist's or pharmacy technician's license unless required continuing education was done; the text did not address doing it after applying.

NowPharmacists and pharmacy technicians may finish required continuing education after submitting the renewal application and paying the fee, but it must be completed before the license expires for that renewal cycle. The board must update its renewal application and procedures to match.

  • NowWhen a business holding a valid board permit changes owners, it may keep operating under the existing permit while the new owner's application is reviewed if the new owner notifies the board within 7 calendar days and submits a permit application within 30 calendar days after the ownership change, the business stays in compliance, the permit is not expired, suspended or revoked, and the new owner attests to taking responsibility for compliance.

  • NowThe board may deny this continued operation if the ownership change presents a risk to public health or safety, the new owner fails a condition, or the board has credible evidence of fraud, diversion or other grounds for permit denial. It ends automatically when the board issues or denies the new permit, and the business is subject to inspections, reporting and enforcement like a permitted entity.

  • BeforeA pharmacist or pharmacy could use an employee or common carrier to deliver prescriptions to a medical practitioner's office or home, a patient's residence, or a patient's hospital.

NowUnless prohibited by federal law, deliveries may go to a medical practitioner's home or office, the patient's residence, a hospital, long-term care facility or workplace, or another physical address the patient provides where the patient or the patient's designated agent is available to receive it.

  • BeforeThe list of prohibited acts did not include wholesaling or distributing without a permit.

NowWholesaling or distributing a prescription drug or device, a controlled substance, a nonprescription drug, a regulated chemical, medical gas or durable medical equipment without a valid board-issued permit is listed as a prohibited act. Other wording in the prohibited acts list was reworded without changing its meaning.

Who it affects

  • Pharmacists
  • Pharmacy technicians
  • Patients receiving delivered prescriptions
  • New owners of businesses holding Arizona State Board of Pharmacy permits
  • Wholesalers and distributors of drugs, devices, medical gas and durable medical equipment
  • Arizona State Board of Pharmacy

What you need to do

Pharmacists and pharmacy technicians who apply to renew before finishing continuing education must complete it before their license expires for that renewal cycle. New owners of a permitted business who want to keep operating must notify the board within 7 calendar days and submit a permit application within 30 calendar days after the ownership change.

What the law doesn't answer

  • What penalty applies to wholesaling or distributing without a permit under this law
  • What happens if a pharmacist or technician applies to renew but does not finish continuing education before the license expires
  • How the board decides that an ownership change presents a risk to public health or safety
  • Whether a new owner pays any fee for continued operation during the transition
  • Whether 'workplace' in the delivery rule means the patient's workplace
  • What form the new owner's attestation must take

This summary describes the law as enacted. Later laws, court rulings or referendum petitions can change the picture. Check the official text for the current wording.
