HB2092In effect since September 12, 2026

People who may choose not to join the Arizona State Retirement System because they reach ASRS eligibility at age 65 or older now qualify based on when they become eligible to participate, not when they were hired, and their 30-day window to opt out starts then.

Official title: ASRS; eligibility waiver

What changes

  • BeforeA person could opt out of ASRS if they became employed by an ASRS employer after reaching at least age 65 and met the other conditions.

NowA person may opt out of ASRS if they become eligible to participate in ASRS after reaching at least age 65 and meet the other conditions.

  • BeforeThe written opt-out had to be filed with ASRS within 30 days after employment.

NowThe written opt-out must be filed with ASRS within 30 days after becoming eligible to participate in ASRS.

Who it affects

  • Workers who become eligible for ASRS at age 65 or older and have no prior ASRS membership, credited service or prior service, and are not receiving benefits under article 2.1 of this chapter
  • Arizona State Retirement System (ASRS)
  • State agencies and local governments whose employees are covered by ASRS

What you need to do

Nothing, unless you are eligible and want to opt out. In that case, you must file your choice in writing with ASRS within 30 days after becoming eligible to participate. The choice cannot be undone for the rest of that job and gives up all ASRS benefits.

What the law doesn't answer

  • What situations cause someone to become eligible to participate in ASRS at a time other than when they are hired
  • Whether the change applies to people who were hired or became eligible before the law takes effect
  • How ASRS will notify people of their eligibility or of the 30-day deadline

This summary describes the law as enacted. Later laws, court rulings or referendum petitions can change the picture. Check the official text for the current wording.
